Terms & Conditions

1.) PAYMENT

  • The deposit guarantees that you will keep your assembly date and is non-refundable.  However, the assembly date is adjustable due to issues such as non-delivery or landscaping issues, allowing it to be rescheduled to a future date with a 24-hour notice.
  • The balance is due to the crew upon completion on the day of the assembly and must be paid in cash, as stated in these ‘Terms and Conditions’.  Please have the cash payment ready in advance.
  • Our crews travel extensively throughout New England, often working long days, so banking and other check-related issues can be particularly challenging.  At the same time, they have daily travel and work expenses to meet.

2.) SELECTING A SITE:

  • The area where you want the playset placed must be relatively flat and level.  As with most playset kits, if the ground is not level, the playset will not be level and possibly unsafe.  The customer is responsible for ensuring the playset is flat and level enough before our arrival.  If possible, we will do our best to assemble and install your playset in your selected location.  Here is a link to a video that may be helpful.
  • Select a site in your yard that is level and free of rocks, stumps, roots, tall grass, trees, and other obstructions.
  • Site preparation must be completed before the installation date.
  • Select a site with good drainage and no water collection.  Swing sets installed in areas of poor drainage will void the product warranty.
  • Please do not place any soft-landing fill in the playset area, such as mulch, wood chips, pea gravel, etc., before the assembly and installation of the playset.  The playset needs to sit on and be anchored to solid ground.
  • ASTM Guidelines recommend a 6-foot safety zone around your entire playset.  You may add this safety zone to the dimensions shown for the playset model you purchase.  However, please note that this requirement only applies to playground equipment with public access.  Also, make sure that there are no overhead protrusions, such as tree branches.

3.) PARTS INVENTORY

  • The homeowner will ensure that all boxes have arrived.  Please do not open any sealed boxes.  However, if any boxes arrive open or damaged, please inventory these boxes for missing or damaged parts.  Each box should have an inventory sheet.
  • Please move all loose pieces to the playset area.  We will move any heavy sealed boxes, but it adds a lot of time to our day if we need to move armfuls of loose pieces.  There would be an additional charge for this service.
  • Any missing parts should be ordered and received before we arrive to assemble your playset.  We are not responsible for damaged or missing parts.  A second trip to install them would require an additional $100 trip charge.

4.) BEFORE OUR ARRIVAL

  • The homeowner will ensure that the playset and surrounding work areas are clear and unobstructed. 
  • If your playset is on grass, it should be freshly mowed.  It makes it very difficult to find any dropped screws in tall grass.  We do not want a child to be injured by stepping on a sharply pointed screw after the assembly.
  • If you use a fill such as mulch, wood chips, or pea gravel, please add it after the playset is assembled and installed.  The playset must sit on and be anchored to solid ground.
  • The homeowner will keep children away from the work area until the installer gives the OK to start playing.
  • The homeowner will keep all dogs inside or on a leash away from the work area until the installer leaves the property.
  • The homeowner will ensure that all pet feces have been cleaned up in the area, that all lawn sprinklers have been turned off, and that any scheduled lawn care services have been canceled for the day.
  • The homeowner will ensure that all lawn sprinklers have been turned off and will be responsible for any sprinkler system components that interfere with the installation of the swing set.
  • The installer will not be responsible for damage to sprinkler system components located within the designated work area.

5.) IN CASE OF RAIN

  • Please be aware that all installation dates are tentative due to unforeseen circumstances that may arise, such as inclement weather.
  • We typically work during occasional light showers or rain, which occur only part of the day.  It is a judgment call on the installer’s part, but we strive to complete your assembly on the scheduled day.
  • However, the installer may need to postpone if steady rain is predicted for the day or even a good part of the day.  The assembly manuals, as do our cordless drivers, cordless drills, battery chargers, and other tools, tend to get damaged.
  • If we need to postpone, we will reschedule as soon as possible.  This may mean assigning it to someone else to work on or even doing two in a day.  We will always do our best to complete your playset assembly as soon as possible.

6.) OUR ARRIVAL

  • We typically arrive between 7:00 a.m. and 8:00 a.m., unless other arrangements have been made.  Your assembler has your contact phone number and will call you if they are going to be more than 5 or 10 minutes late.
  • Sometimes your assembler may have two assemblies in one day.  In this case, they will call you in advance to work out an alternative arrival time, should it differ from 7 and 8 a.m.

7.) YOUR PRESENCE IS REQUESTED

  • We request that you or an adult representative at least 18 years of age be home during the installation.  This individual must have the authority to authorize the correct placement of the swing set and to make decisions or answer questions that may arise.  Moving the swing set after installation will result in additional charges.
  • If you must leave, please make sure that we can reach you.  Additionally, please ensure that either the assembler has received payment before you leave or that you have arranged for this to be done upon completion of the assembly.

8.) CANCELLATION OR POSTPONEMENT OF YOUR ASSEMBLY AFTER OUR ARRIVAL

  • If you decide to cancel or postpone your assembly after our arrival, a $100.00 trip charge will be payable to the installer to help cover travel expenses and lost time.
  • We may inform you of an issue with your location or the playset.  However, you hired us to assemble it, and that is what we came to do.  You decide whether or not to proceed.  We are simply looking out for your best interests and the safety of your children.

9.) PLAYSET LOCATION MUST BE FLAT & LEVEL

  • The area where you want the playset must be flat and level.  As with most playset kits, if the ground is not level, the playset will not be level and may be unsafe.  If your playset area is not level, here is a link to a video that may be helpful.
  • In addition to safety concerns, some playsets cannot be constructed on a flat and level area.  This is particularly important when a bridge or stairs connect two towers or fort structures.
  • You can check the level by measuring and marking out the size area needed for your playset.  Then, with some inexpensive wood stakes, line, and a line level obtained at your local hardware store, you can check the area for levelness front to back and side to side.
  • If you are unsure whether the area is flat and level across a large enough space for your playset, please consult a landscaper.  Due to our schedule and the distances we travel, we are unable to make a special trip to survey your site. 
  • The homeowner is responsible for ensuring that the area is sufficiently flat and level to assemble and install the particular playset.
  • When we arrive, if we find that your chosen playset area is inadequate, we may advise you or suggest another location, but the choice is always yours.  Based on our advice, if you decide that additional landscaping work is needed before assembly, a $100.00 trip charge will be payable to the installer at the time of assembly.  They have travel expenses and have lost a workday.
  • We cannot sink the playset posts or sections into the soil to level the playset.  All wood placed beneath the soil will rot regardless of the type of wood.

10.  LEVELING YOUR PLAYSET AREA

  • We do not provide general landscaping or earthmoving services.  We do not have the necessary equipment or tools to do so, and there is typically insufficient time during a workday for us to complete both landscaping and the assembling of the playset.  Due to the distance that we usually travel, it is more cost-effective for you to hire a local landscaper for this purpose.

11.) POSITIONING OF YOUR PLAYSET, SWING SET, OR PLAYSCAPE

  • Please indicate where you would like the playset positioned before assembly.  You can mark this area by measuring the size of your playset and placing markers to indicate the exact location.
  • Moving your playset after it is assembled will incur an additional cost.  This is very difficult without removing the swing beam, rock wall, slide, ladder, any bridges, and disconnecting from other towers if they exist.
  • If you are unsure of the exact positioning, please inform the installer in advance so you can inspect it once the tower is assembled.  The assembled swing beam can then be held up to the completed tower so you can see what the completed playset and positioning will look like before the completion, and attach all of the peripheral components.

12.) ALTERATIONS

  • We assemble your playset according to the instructions in the assembly manual.  Alterations may damage the playset or cause other safety and liability issues.

13.) SAFETY CONCERNS

  • Please keep all pets, children, and helpful or curious adults out of the area.  Our typical day is very full, and we need to be able to work safely, quickly, and uninterrupted.

14.  DAMAGED OR MISSING PIECES

  • Please be aware that the majority of these playsets are imported from China.  Although the wood is often referred to as “cedar,” it is not cedar.  The wood is cypress wood (Cunninghamia Lanceolata), a significant export from China.  It is a very fast-growing cypress wood that has many of the rot-resistant characteristics of cedar, but it is much lighter and more brittle than cedar.
  • Often, boards arrive damaged or split.  Also, even though many arrive pre-drilled, or we pre-drill them and then only seat the screw flush or just slightly below the surface, they still split.  This is typically not the assembler’s fault.
  • The manufacturer can replace any damaged or missing boards.  Most playset companies are very aware of this issue and are very good about sending replacement boards.  However, we cannot return and install any replacement pieces, and they will not be included in the original assembly fee.  You can negotiate with the assembler, do it yourself, or hire a local handyperson to do it for you. 

15.) UP-CHARGES

  • Typically, there are no up-charges for the vast majority of assemblies.  Some examples of the need for an up-charge would be:
  • A.) Installation cost includes most locations throughout New England.  An additional mileage charge may apply for remote locations that are not easily accessible.
  • B.) Someone has attempted to put the playset together, and due to improper assembly, we have to take it apart and start over, adding a significant amount of work and time to the assembly.  Additionally, parts are sometimes missing or scattered, making them difficult to locate.  Often, parts have been exposed to the weather for so long that they become damaged, or it is difficult or impossible to read the part numbers. 
  • C.) The area where the playset is going is far away from the boxes, or we have to move them over rugged terrain, significantly adding to the assembly time and labor.  We price assemblies based on the typical distance of moving the playset boxes from the average garage or driveway to the other side of the house, with good access to a typical backyard area within proximity to the house.
  • D.) The boxes have been opened with loose parts away from the assembly area.  Transporting armfuls of loose parts can add time to our assembly and labor.
  • E.) We are asked to level the playset area, which is within our capability, but is not included in the assembly price.
  • Upcharges for these types of issues are at the discretion of the assembler.  The assembler should state these either upfront, when the assembler is asked to perform the additional work, or as soon as the assembler realizes that additional time and labor will be involved.

16.) BOXES AND PACKING MATERIALS

  • The installer will condense all packaging materials and place them in or near your trash bins at your discretion.  Removal of the packing materials or pallets is not included.

17.) FINAL INSPECTION

  • Please ensure you have inspected the playset and are happy with the assembly before paying the installer the balance, and the crew leaves.  Due to our schedule and the distance traveled, we are unable to return to address any issues that may arise.
  • Your lead assembler is an independent contractor who is fully responsible for the safe and correct assembly and installation of your playset or swing set.  Please discuss any issues or concerns you may have with them.  However, if a problem cannot be resolved or you are dissatisfied with your assembly, I would appreciate hearing about it.
